Can I use copyrite names in my domain name?

I would like to incorporate the word "botox" in a domain name, but see that the word appears to be copyrited. Would there be a problem with using "botox" as part of my domain name?

Public Comments

  1. As the owner of the name, they can petition internic to transfer the name to them.
  2. Names can't be copyrighted. They can be trademarked. If botox is trademarked (and I would guess that it is) then any domains containing it would be subject to your domain registrar's dispute policy. You would surely lose. In fact, I would expect the trademark holder of such a valuable trademark has an attorney who uses an automated program to check all new registrations, and quickly send out a cease and desist letter to you. see chillingeffects.org for details.
  3. You may face a problem if there is a trademark
